Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "Client," or "you") and XtraMile ("XtraMile," "we," "us," or "our"). By accessing or using the XtraMile website, Discord server, marketplace, ticket system, or any services provided by XtraMile, you acknowledge that you have read, understood, and agreed to be bound by these Terms.

If you do not agree with these Terms, you must not use our services.

1. Scope of Services

XtraMile provides digital development services primarily focused on the FiveM ecosystem, including but not limited to:

  • Custom vehicle models and liveries
  • Emergency/LEO lighting configurations
  • Scripted or integrated vehicle functionality
  • Server-ready assets and configurations
  • Marketplace listings created by XtraMile or approved developers

Services may be offered as custom commissions, limited-release products, or storefront purchases.

2. Base Models & Third-Party Assets

Some XtraMile products are built using base models or assets purchased or licensed from third‑party developers.

  • XtraMile does not claim ownership of third‑party base models.
  • All original creators retain ownership of their underlying assets.
  • XtraMile retains rights only to the modifications, configurations, and derivative work created by its developers, to the extent permitted by the original license.

3. Custom Builds & Commissions

3.1 Made‑to‑Order Work

Custom builds are created specifically to client specifications.

  • Prices are set by the individual developer.
  • Quotes are estimates and may change if scope changes.
  • Additional parts or licensed assets required for completion must be paid up‑front.

3.2 Changes & Scope Creep

  • Any changes requested after a build has been approved or started may result in a price increase.
  • Scope changes do not reset payment deadlines.

3.3 One‑of‑One Builds

For one‑of‑one or exclusive vehicles:

  • Payment must be completed within 24 hours of invoice issuance.
  • Failure to pay within 24 hours allows XtraMile to list the product publicly in the store.
  • If you leave or are banned from the XtraMile Discord, exclusive assets may be listed for sale.

4. Payment Terms

  • All payments must be completed in full before delivery.
  • Failure to pay after completion will result in:
    • Immediate service termination
    • Permanent ban from XtraMile systems
  • Fraudulent or disputed payments may result in asset revocation and blacklisting.

Final Sale Policy

ALL SALES ARE FINAL. NO REFUNDS. NO EXCHANGES.

By purchasing from XtraMile, you waive all rights to refunds or charge reversals.

Any attempted chargeback or payment dispute may result in:

  • Permanent ban
  • Asset revocation
  • Reporting to developer protection organizations
  • Legal action where applicable

5. Delivery

  • Completed products are delivered digitally via Discord ticket, private message, or another agreed electronic method.
  • Delivery does not include vehicle slot allocation or server configuration unless explicitly stated.

6. Handling & Performance

  • Vehicles are delivered with stock/basic handling unless otherwise agreed.
  • Performance tuning or custom handling must be requested and paid for separately.

7. Licensing & Intellectual Property

Unless explicitly stated otherwise:

  • All products are licensed, not sold.
  • You are granted a non‑exclusive, non‑transferable, revocable license to use the product on approved servers.

You may NOT:

  • Redistribute, resell, sublicense, or share assets
  • Unlock or rip vehicle files
  • Upload assets to third‑party stores

Violation will result in:

  • Immediate blacklist
  • Reporting to Protect The Developers and similar organizations
  • Possible legal action

8. Warranty

XtraMile provides a 30‑day limited warranty from delivery date.

  • Bugs or defects caused by XtraMile will be fixed at no charge.
  • Warranty does not cover:
    • Third‑party modifications
    • Server misconfiguration
    • User‑induced damage

9. Developer‑Specific Terms

Some developers operating under XtraMile may have additional terms.

  • You are responsible for reviewing any developer‑specific TOS before purchasing.
  • Developer terms supplement, but do not replace, this agreement.

10. Termination & Enforcement

XtraMile reserves the right to:

  • Suspend or terminate access at any time
  • Revoke licenses for TOS violations
  • Remove assets from servers

Termination does not entitle the user to any refund.

11. Limitation of Liability

XtraMile is not liable for:

  • Lost profits, data, or revenue
  • Server downtime or incompatibility
  • Indirect or consequential damages

Use of XtraMile assets is at your own risk.

You agree to indemnify and hold harmless XtraMile, its developers, and affiliates from any claims arising from your use or misuse of our services.

12. Modifications to Terms

XtraMile may update these Terms at any time.

  • Changes are effective immediately upon posting.
  • Continued use of services constitutes acceptance of revised Terms.

13. Governing Law

These Terms shall be governed and interpreted under applicable United States law, without regard to conflict‑of‑law principles.
